Some legal scholars have asserted that rigid notions of homosexual identity shape adjudicators’ approach when evaluating asylum claims based on sexual orientation. Recent ethnographic research at the French Court of Asylum, in charge of reviewing appeals on decisions from the French Office for the Protection of Refugees and Stateless Persons, shows indeed that adjudication is based on particular gender stereotypes. However, my analysis centers on an unexplored but related issue: the relationship between the problems raised by adjudicators when facing what they call “intimacy cases,” specifically regarding the administration of proof and stereotyped performances. Through ethnographic data drawn from encounters with adjudicators and asylum seekers at the French Court of Asylum; through interviews with judges, rapporteurs (reporters), interpreters, and lawyers; and by examining 60 court rulings, I argue that sexual orientation-based cases crystallize the importance of intimacy in the politics of asylum, helping to seize the new shapes of the refugee as well as the growing difficulties for judges in relying on material evidence.

This article explores the framing of conflicts over public space as they unfold in a climate of neoliberal urban transformation in contemporary Germany. Examining how the alleged concerns of a ‘queer community’ have been pitted against the alleged moral agenda of Muslim immigrants in the country, examples of conflicts over ‘queer’ public leisure spaces in Berlin will give insights into how different cultural minority positions are mobilized against each other in the context of both urban and national citizenship debates that are marked by a neoliberal re-evaluation of diversities and inequalities.

Asylsuchende transgeschlechtliche Menschen sind im Zuge ihres Verfahrens mit besonderen Herausforderungen konfrontiert. Sie stehen vor der Hürde, ihre Glaubwürdigkeit, die zugleich Kern des Asylverfahrens bildet, vor dem Hintergrund liberalerAuffassungen von Staatlichkeit und Politik sowie einer verallgemeinerten dominan-ten Wahrnehmung sozialer Wirklichkeit, die von Heteronormativität und naturalisierter Zweigeschlechtlichkeit geprägt ist, zu etablieren. Dieser Beitrag befasst sichmit der Situation von transgeschlechtlichen Menschen aus Ecuador und Peru, die sichunter Berufung auf politische Verfolgung in ihren Heimatstaaten in der Bundesrepublik Deutschland um Asyl bemühen. Nach einer Darlegung der rechtlichen Grundlagen und einer Beschreibung des Verfahrens folgen Fallbeschreibungen von drei Transfrauen aus je einer Entscheidungsphase des Asylverfahrens. Anhand einer Analyse und theoretischen Einordnung prägnanter Aussagen der jeweiligen Entscheiderin den Fallbeispielen wird deutlich, dass obengenannte Normen und Verfahrenswei-sen ineinander greifen. Dies geschieht zudem in einem Maße, dass nicht davon ausgegangen werden kann, dass das Asylverfahren unter den gegebenen Umständen transgeschlechtlichen Menschen strukturell und individuell Schutz vor Verfolgungbieten kann.

Der Begriff der „politischen Verfolgung“ ist eine deutsche Erfindung. Flüchtling ist, wer Verfolgung zu befürchten hat, gegen die kein Schutz besteht, und zwar wegen seiner Rasse, Religion, Nationalität, politischen Überzeugung oder Zugehörigkeit zu einer bestimmten sozialen Gruppe. Diese menschenrechtlich geprägte Definition erfasst heute sowohl verfolgte Homosexuelle als auch manche Kriegs- und Wirtschaftsflüchtlinge.

Der Schutz vor geschlechtsspezifischer Gewalt in Flüchtlingsunterkünften weist erhebliche Defizite auf. Die Europaratskonvention gegen Gewalt gegen Frauen sieht detaillierte Verpflichtungen des Staates zum Schutz vor Gewalt vor. Diese beziehen sich auch auf geflüchtete Frauen, die aufgrund der strukturellen und rechtlichen Rahmenbedingungen ihres Lebens in Unterkünften in ihrer Autonomie, ihrem Zugang zum Recht und damit in ihrer Wehrfähigkeit eingeschränkt sind. Das Papier gibt konkrete und detaillierte Empfehlungen für eine menschenrechtskonforme Weiterentwicklung des Gewaltschutzsystems für Asylsuchende und Geduldete in Flüchtlingsunterkünften.

For social workers striving for cultural competency and strength-based approaches with refugees resettled in the West, attention to the role of religion and faith as potential resources is particularly vital. With rising numbers of refugees fleeing from Islamic societies to Western host countries over the past two decades, social work research has articulated Islam as a source of strength and group solidarity, as well as the trigger for anti-Islam bias and discrimination. However, Muslims are not a monolithic group. This article reports on a qualitative study with fourteen Muslims seeking US asylum due to persecution based upon their gender role non-conforming behaviours. Findings suggest that, for persons in this category, relationships to religion and faith may be complex, and potentially traumatic. Creating opportunities for gender role non-conforming refugees from Islamic societies to discuss religion and spirituality, with appropriate psychological support and without judgements from co-ethnic others or service providers, is an important clinical intervention for social workers to consider.

Portugal’s migration history has been extensively explored in academic literature, including in legal scholarship. Yet, very little attention has so far been directed towards Portuguese refugee law. This may be due to the relatively low number of asylum seekers that Portugal receives, but that does not justify neglecting the study of the Portuguese socio-legal framework applicable to asylum seekers and refugees. This article addresses this gap by analyzing the framework in a European context, enhancing the analysis with a case study of lesbian, gay, bisexual, transsexual, and intersex (LGBTI) asylum seekers. The analysis explores the evolution of the current legal framework, the procedures and remedies available to asylum seekers, the substantive standards applied in decision making, and the broader socio-legal resources offered to asylum seekers. Several shortcomings and possible avenues of improvement are also identified.

Our article is about the new relevance of the category of “the homosexual” in immigration policies. This novelty is paradoxical: while homosexuality had previously been defined exclusively in negative terms, from the point of view of the State, it has now assumed a positive value in the West—since it can be invoked to justify asylum seeking. The argument has two prongs. On the one hand, taking homosexuality into account for immigration control implies a definition of gay identity. On the other, the objects of these policies are also subjects: their own identity is caught up in this transnational process of identification. Fieldwork for this article was conducted in France on bi-national same-sex couples. However, the new categorization of homosexuality extends far beyond—in Europe and throughout the world. We argue that the politics of identity are not just, and not primarily about identity politics; they have to do both with politics in general and policies in particular.
